User Agreement

Welcome to SkyVault Servers LLC! This User Agreement is a legally binding contract between you (the “User”) and SkyVault Servers LLC (“we,” “our,” or “us”) governing your use of our website, products, and services. By using our services, you agree to this agreement.

If you do not agree to these terms, you must discontinue using our services immediately.

1. Acceptance of Terms

By signing up for or using our services, you acknowledge that you have read, understood, and agree to be bound by this User Agreement, as well as our other policies, including the Privacy Policy, Terms of Service, and Acceptable Use Policy.

2. Eligibility

  • You must be at least 18 years old to use our services.
  • By creating an account, you represent that you have the authority to enter into this agreement.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your login credentials.
  • You agree to provide accurate, current, and complete information during the signup process and update it as necessary.
  • Unauthorized use of your account must be reported to us immediately.

4. Prohibited Activities

When using our services, you agree not to:

  • Engage in any illegal activities.
  • Use our services to host harmful, offensive, or unauthorized content (e.g., malware, phishing sites, spam).
  • Overuse server resources in a manner that disrupts other users.
  • Attempt to gain unauthorized access to our systems.

Violating these rules may result in account suspension or termination.

5. Payments and Fees

  • All services require upfront payment as per the selected billing cycle.
  • Invoices must be paid promptly to avoid suspension or cancellation of services.
  • SkyVault Servers LLC reserves the right to modify pricing with prior notice.

6. Service Availability

  • We strive to ensure 99.9% uptime for all services. However, temporary interruptions may occur due to maintenance or factors beyond our control.
  • We are not liable for service disruptions caused by third-party providers, natural disasters, or other uncontrollable events.

7. Data Ownership and Security

  • You retain ownership of your data hosted on our servers.
  • We implement industry-standard measures to protect your data but cannot guarantee absolute security.
  • You are responsible for maintaining backups of your data.

8. Termination of Services

  • Either party may terminate this agreement at any time.
  • If you wish to terminate your account, you must notify us in writing.
  • SkyVault Servers LLC may terminate or suspend accounts that violate this agreement or fail to pay for services.

9. Limitation of Liability

  • SkyVault Servers LLC is not liable for damages arising from the use or inability to use our services, including but not limited to data loss, business interruptions, or security breaches.
  • Our total liability is limited to the fees paid for the affected service during the 12 months prior to the event.

10. Dispute Resolution

  • Any disputes arising under this agreement shall be resolved through good faith negotiation.
  • If a resolution cannot be reached, disputes may be submitted to arbitration in accordance with the laws of the state of Kentucky, USA.

11. Changes to the Agreement

SkyVault Servers LLC reserves the right to update this User Agreement at any time. Changes will be communicated via email or website updates. Continued use of our services after changes are made constitutes acceptance of the updated agreement.
